The National Superintendence of Public Registries (Sunarp), attached to the Ministry of Justice and Human Rights (MINJUSDH), after an arduous work of regulatory purification, issued a resolution identifying the regulations that regulate the registration procedure and advertising services, issued between the years 1999 to 2022 that is in force, as well as the one that is no longer. , with the purpose of having a set of current registration regulations that facilitate its access and dissemination to citizens and operators of the registration system.
According to Resolution No. 033-2022-SUNARP/SN, Sunarp carries out the process of regulatory regulatory purification, based on the review, consolidation and systematization of the regulations, directives and guidelines issued by the same entity, whose matters include the registration procedure and advertising services, identifying cases of tacit derogations due to the issuance of higher-ranking regulations, temporary validity, fulfillment of institutional objectives and cases of regulatory obsolescence (old), attending to the implementation of new management processes and to the progress of the computer developments implemented by the Superintendency in public registry services, especially during the health emergency due to the COVID-19 pandemic.
In article 3 of the aforementioned Resolution, it is added that the registration regulatory purification includes the regulations issued by the bodies that have the regulatory power of Sunarp, as well as the regulations, directives and guidelines that regulate the registration procedure and the registration advertising service. It is also indicated that, having identified the current regulations, the articles or provisions within them that may have been expressly modified or repealed by other regulations have been taken into account.
Among the repealed regulations is Directive No. 001-2004-SUNARP/SN, which provides for the implementation of the Public Registry of Interest Management in the Registry of Natural Persons of each Registry Zone and approves registration formats, according to the Resolution of the National Superintendent of Public Records No. 013-2004- SUNARP-SN.
This Directive was tacitly repealed by Legislative Decree 1353, which creates the National Authority for Transparency and Access to Public Information, strengthens the Personal Data Protection Regime and the regulation of interest management, implementing a new interest management regime. , in addition to other provisions, repeals several articles of Law 28024 referring to the public registry of interest management in charge of Sunarp.
Similarly, Directive No. 08-2015-SUNARP/SN issued on October 7, 2015, which regulates the registration application submitted electronically by the Notary regarding acts contained in notarial documents, was repealed, according to the Resolution of the National Superintendent of Public Registries No. 253-2015-SUNARP/SN. It was repealed because it fulfilled its objective and due to obsolescence, based on the use of the digital signature by a notary through the Digital Intermediation System (SID Sunarp).
It is worth mentioning that the legal device that bears the signature of the national superintendent, Harold M. Tirado Chapoñan, indicates that the Sunarp Board of Directors, in its virtual session No. 429 of March 8, 2022, unanimously approved this resolution which provides for the purification of the regulations that regulate the registration procedure and the advertising services issued between the aforementioned years that are in force, as well as those that are no longer in force.
