Study shows failure to comply with the Quota Law in São Paulo companies

The number of companies in São Paulo that failed to comply with the norm that requires the inclusion of professionals with disabilities in the workforce in 2019 reached 82.4%, reveals a study developed by the Center for Union Studies and Labor Economics of the Institute of Economics of the University State of Campinas (Unicamp). According to the study, among 11,751 companies in São Paulo, with headquarters in the state of São Paulo and branches in different locations across the country, under the same CNPJ, only 2,067 (17.6%) were meeting the quota that year.Study shows failure to comply with the Quota Law in São Paulo companies

In the area covered by the 15th Region (comprising 599 municipalities in the interior and on the north coast), of 4,813 companies, 22.3% met the quota, representing a higher percentage than that found in the total of companies in the state of São Paulo. Considering only the area of ​​the 2nd Region (comprised of 46 municipalities in the metropolitan region of São Paulo and Baixada Santista), of 6,938 companies, 14.4% were meeting the quota, a percentage lower than that found in the entire territory of São Paulo.

The Quota Law obliges companies that have 100 to 200 employees to keep 2% of employees with disabilities on their staff. In organizations with a number of 201 to 500 workers, the percentage rises to 3%. When composed of 501 to 1,000 employees, the company must have 4% of workers with disabilities hired. Finally, in companies with a thousand or more employees, the percentage should be 5%.

In 2019, of the 317,179 jobs available in the 11,751 companies in São Paulo, 145,801 (46%) were filled, with 171,378 jobs not being filled, that is, 54% of the vacancies reserved for people with disabilities. In the area of ​​the 15th Region, of the 86,831 expected vacancies, 40,532 were filled, equivalent to 53.3%. Therefore, 46,299 (46.7%) formal jobs secured by the reservation of vacancies were not filled. In the area of ​​the 2nd Region, according to the data, of the total of 230,348 expected vacancies, 105,269 were filled, corresponding to 45.7% of the total. 125,079 (54.3%) of these vacancies were not filled.

According to the Unicamp study, in the state of São Paulo, an estimated 1,791,627 people with disabilities in the age group between 16 and 64 years old were considered potentially suitable for the job market. According to data from the Annual Report of Social Information (Rais), Annual Report of Social Information (Rais) of the same year, 145,801 people in this group were formally employed, around 8.2%. On the other hand, 171,378 people were not hired, corresponding to 9.6% of the working age population.

In the 15th Region, the data pointed to 800,201 people with disabilities of age potentially able to work. Of these, 40,532 (5.1%) were in the formal job market, but 46,299 jobs were not signed with people with disabilities, around 5.8% of the total population potentially able to work. In the area of ​​the 2nd Region, an estimated 991,427 people with disabilities in the age group between 16 and 64 years of age were estimated, among which 105,269 (10.6%) had employment contracts. 125,079 people with disabilities were not formally hired, that is, 12.6% of the total population with disabilities able to work in 2019.

“Some companies hire, but do not fill the quota. Sometimes companies say that there are no people with disabilities or that the qualification is insufficient for hiring. There are many rhetorics, but with this study, we saw that we have a sufficient number of people”, said one of those responsible for the research, Garlanda de Castro Benevides.

For her, the argument of low qualification is unfounded, because, when you look at the data of people hired, they have a level of education similar to that of people without disabilities. “There is a difference, but this is due to the process of including people, which began to change with the Quota Law. But schooling is not something that prevents hiring”, said Garlanda.
