Minister Reynaldo Soares da Fonseca, of the Superior Court of Justice (STJ), ordered the release of digital influencer Dilson Alves da Silva Neto, better known as Nego Di, this Wednesday (27).
He was arrested in July this year on suspicion of participating in fraud on social media involving illegal virtual raffles.
In the decision, the minister replaced the arrest with precautionary measures, such as banning the use of social networks, withholding the passport and periodically appearing in court.
For the minister, the accusations against the influencer are ongoing in a criminal case and do not involve violence or serious threats. In this way, prison can be replaced by measures.
“The patient has favorable personal conditions, such as primary status, fixed residence. Although these aspects do not guarantee a right to release, they must be considered for the purposes of granting provisional release, as in the case under examination”, decided the minister.
The accusations against Dilson Alves were carried out by the Public Ministry of Rio Grande do Sul (MPRS) as part of Operation Rifa and involve around R$2 million.
