Supreme Court Justice Luiz Fux has scheduled a hearing to offer a deal to federal deputy Nikolas Ferreira (PL-MG), accused of the crime of slander against President Luiz Inácio Lula da Silva. The meeting will be on August 14. Fux is the rapporteur of the case.
The benefit was offered last month after the Attorney General’s Office (PGR) report the parliamentarian to the Supreme Courto. The measure is adopted in crimes where punishment is low. According to the Penal Code, insult is punishable by a sentence ranging from one to six months in prison, which can be converted to alternative sentences.
The complaint involves the congressman’s speech during a meeting at the United Nations (UN) in 2023. Nikolas called Lula a “thief” and published the speech on his social media.
At the hearing, a representative from the PGR will offer the congressman a plea bargain, a type of agreement in which the accused agrees to comply with measures determined by the prosecutor’s office in exchange for the closure of the case. If the case is dismissed, the congressman will not be convicted. If the congressman does not accept the agreement, the case will proceed as normal.
