Unanimously, the ministers of the Federal Supreme Court (STF) recognized the right of Jehovah’s Witnesses to refuse blood transfusions in procedures carried out in the public health system.
This rule, however, will not apply to those under 18.
Adults will be entitled to alternative treatment available through the Unified Health System, in the same place of residence or another. All costs must be paid by the State.
The STF ministers understood that the refusal of blood transfusion is based on the constitutional principles of human dignity and religious freedom.
In a statement, the Jehovah’s Witnesses Association of Brazil said that the decision provides legal certainty to patients and doctors. For them, Brazil is now in line with other countries that also recognize this right, such as the United States, Canada and Chile.
