The Minister of the Federal Supreme Court (STF) Luís Roberto Barroso yesterday (27) denied a request from the Movement of Homeless Workers of Paraná (MTST) to bar the repossession of an urban area in the Tatuquara neighborhood, in Curitiba. The occupation brings together about 700 families.
The case reached the Supreme Court after the defense of the MTST alleges failure to comply with the minister’s decision, later endorsed by the Court, which suspended evictions and evictions due to the covid-19 pandemic until October 31 of this year.
When analyzing the case, Barroso understood that the occupation is not supported by the STF because it took place after March 31, 2021, the date on which the decision was reached.
“The controversy involves very recent occupation, started on 06.11.2022, by needy families, in a property located in the city of Curitiba. In view of this, first of all, it is necessary to point out that the occupants, despite being in a situation of social vulnerability, do not benefit from the last decision made by me in ADPF 828, and ratified by the plenary, which extended the suspension of collective evictions and evictions until 10.31.2022. This is due to the date when they started to settle in the place: June of this year”, justified the minister.
In the action, MTST alleged that the land occupied by the occupation had been abandoned for more than 30 years and that the registration of the families occupying the area had not been completed, as determined by the Court in cases of evictions.
The construction company responsible for the area defended compliance with the repossession and reiterated its commitment to the relocation of families.
