The Federal Supreme Court (STF) decided to maintain the prison by Filipe Martins, former international affairs advisor to former president Jair Bolsonaro, after a custody hearing this Friday afternoon (2). The hearing via videoconference, from the Public Prison of Ponta Grossa (PR), the city in which he was arrested, was carried out by the assistant judge from Minister Alexandre de Moraes’ office, Flávia Martins de Carvalho. The minister considered that non-compliance with the precautionary measure prohibiting the use of social networks had been proven.

“Effectively, there is no doubt that there was non-compliance with the precautionary measure imposed, since the defense itself recognizes the use of the social network, with no relevance to the defensive allegation in the sense that social networks were used to ‘preserve, organize and audit past information elements relevant to the exercise of broad defense’”, wrote Moraes.

Node last Saturday (27)Moraes ordered the convict to house arrest with the use of an electronic ankle bracelet. However, Martins allegedly failed to comply with the precautionary measures of the criminal action, specifically the prohibition on the use of his own social networks or those of third parties.

In accordance with the decision for preventive detention, a complaint was received on December 29, added to the file, that the former advisor to the Presidency of the Republic had used the professional social network Linkedin to search for other people’s profiles.

On Monday, Moraes notified the defense de Martins and granted 24 hours for clarification on the case. However, his lawyers claimed that Filipe Martins did not have access credentials to his social media accounts and could not publish content: “he has not performed any act on such platforms since the period prior to the imposition of the current precautionary restrictions.”

In the decision, Moraes stressed that Martins had “total disregard for the imposed norms and constitutionally democratic institutions, as, by using social networks, he offends the precautionary measures applied, as well as the entire legal system”.
