The Federal Supreme Court (STF) formed a majority this Friday (10) to maintain the sending of a criminal complaint by Senator Randolfe Rodrigues (Rede-AP) against former President Jair Bolsonaro to the first instance of Justice. The Deputy Attorney General of the Republic, Lindôra Araújo, appealed against the decision of Minister Edson Fachin to send the case to the Court of Justice of the Federal District and Territories (TJDFT) and asked for the case to be closed, as she understands that there is no minimum evidence of crime for the continuation of the criminal action.
In the petition, the senator accuses Bolsonaro of the crime of defamation through social networks. According to the parliamentarian, in July 2021 the former president assigned him the negotiation of Covaxin vaccines against covid-19 without promoting bidding.
The case reached the Supreme Court in the same year, but, in February, Minister Edson Fachin, the rapporteur, sent the case to the TJDFT due to the loss of privileged jurisdiction after Bolsonaro left office as President of the Republic.
So far, six ministers understood that Fachin’s decision should be maintained. Justice André Mendonça voted to close the criminal complaint.
The judgment takes place in the virtual plenary of the Court, a modality in which the votes are inserted in the electronic system and there is no in-person deliberation. Voting continues until 11:59 pm so that the other four ministers can vote.
