Minister Luís Roberto Barroso of the Supreme Federal Court (STF) canceled the plenary session scheduled for the afternoon of Wednesday (10), so that part of the ministers can continue the trial of former President Jair Bolsonaro and allies for an attempted coup.
THE trial was resumed on Wednesday (10) by the first classwhich is composed of five of the 11 ministers of the Supreme – Alexandre de Moraes, Flávio Dino, Luiz Fux, Cármen Lúcia and Cristiano Zanin.
THE Session was opened with the vote of Minister Luiz Fuxwhich in a long demonstration complied with a series of preliminary questions about the conduct of the case, all presented by the lawyers, and opined for annulment of the whole process.
At Fux’s request, the president of the first class, Cristiano Zanin, suspended work for one hour and announced that the trial would continue in the afternoon, which was not previously planned.
Besides Fux, Minister Cármen Lúcia and Zanin himself. The trial began on September 2, with the reading of the report by Moraes and the support of the Attorney General, Paulo Gonet, and the defendants’ defenses.
Vote

In these points, Fux diverged from Alexandre de Mores, rapporteur of the case, and Flávio Dino, who on Tuesday (9) rejected all preliminary prisons raised by the defenses and voted for the conviction of all defendants for the crimes imputed by the PGR.
The only preliminary Fux accompanied colleagues concerns the Awarded denunciation of Lieutenant Colonel Mauro Cid, former Bolsonaro orders who told details about the plot.
The minister voted to validate the military’s statements, although with reduced benefits due to omissions that needed to be remedied throughout the process.

Crimes
Defendants are responsible for crimes of armed criminal organization, attempted violent abolition of the democratic rule of law, coup d’état, damage qualified by violence and serious threat and deterioration of listed assets.
The exception is the case of former ABIN director Alexandre Ramagem who is currently federal deputy. He benefited from the suspension of part of the accusations and responds only to three of the five crimes. The rule is provided for in the Constitution.
The suspension applies to crimes of damage qualified by violence and serious threat, against the union’s assets, with considerable damage to the victim and deterioration of overturned assets, related to the scammers of 8 January.
