The Federal Supreme Court (STF) began deciding this Thursday (17) whether it will approve the Just Penalty Plan, drawn up by the federal government to address the problems found in the country’s prisons.
The plan was filed in September this year as part of the action in which the Supreme Court ordered the elaboration of a national plan to combat problems in Brazilian prisons, such as overcrowding of inmates and disputes between factions. The determination took place in October 2023.
In this afternoon’s session, Minister Luís Roberto Barroso, rapporteur of the case, voted to approve the plan. Barroso considered that the plan meets the requirements of the Court’s decision and serves as a reference for other plans drawn up by public managers.
“The Union’s effort must now continue in the implementation phase. The fight against the unconstitutional state of affairs must be treated as a matter of highest priority for the federal government and state governments, in view of the massive violation of fundamental rights existing”, stated the minister.
After Barroso’s vote, the trial was suspended. The resumption date has not yet been defined.

The Pena Justa Plan is made up of four axes that deal with entry control and vacancies in the prison system; quality of services provided and structure, social and political reintegration so as not to repeat the state of unconstitutionality highlighted by the STF.
The plan also presents indicators and targets for the years 2025, 2026 and 2027.
