From now on, all appointments must be managed exclusively through the new digital platform.
Miami, United States. – Last Thursday, the start -up of the new appointment application system culminated to opt for Spanish nationality under the Law 20/2022by democratic memory (LMD), as confirmed by the Ministry of Foreign Affairs, European Union and Cooperation of Spain, On its website.
From now on, all appointments must be managed exclusively through this new Telematics platform, whose access is available through a form on the website of the Spain Consulate in Havana.
In compliance with Instruction of November 5, 2024 From the General Directorate of Legal Security and Public Faith of Spain, it is established that “all appointments must be requested by this new system, and that the previous credential application is permanently closed.” In addition, it was noted that “all credentials generated by the previous system will be eliminated as of October 22, 2025”.
New quotation system: operation and guarantees
With the objective of guaranteeing the exercise of the right of option to nationality and offering greater agility in applications management, Spain approved modifications to the previous procedure, now allowing the use of digital tools that generate electronic justifying of the application.
According to the new platform, once the form is completed, a “protection with electronic signature (CSV)” will be automatically issued that will be sent to the applicant’s email. More than one application can be made from the same mail.
People who complete this process within the term of the law may submit their application in person at a date after October 22, 2025. “The appointment requests submitted and validated through this new telematics platform, within the term of validity of the Democratic Memory Law, will allow interested persons to appear personally before this Consulate General to submit their application on a date that can be after October 22, 2025 The consulate.
Transition from the previous system
According to The announcement of May 21to facilitate the transition to the new system, the previously registered users were eliminated. “All users who received credentials (user and password) and have not yet reserved the appointment, can only do so with such credentials before [el 23 de junio de 2025]”, Says the statement. Not doing so before that date, its users would be eliminated, and would have to make a new request through the updated system.
However, the new system continues to respect the chronological order of prior application. “Those who have requested their credentials by the previous system and have not yet received them, will receive their corresponding shelter in chronological order and, when the time, their user and password.” In this sense, it is clarified that “those who have already requested their credentials by the previous system, should not repeat their credential application through the new platform.”
Normative changes to facilitate the process
The Instruction of November 5, 2024signed by the general director María Ester Pérez Jerez, modified sections 1.b) and 1.c) of criteria IV of the seventh guideline of the previous instruction of 2022, establishing the legal basis for the new system. In particular, it is indicated that:
“Regarding the consular offices, for all those cases in which the appointment to exercise the right of option to nationality (…) cannot be attended in the deadlines provided for therein, but it has been requested through telematic tools (…) interested persons may submit their application personally after that period.”
It is also established: “The procedure and the terms of correction (…) will be equally applicable to the applications for nationality submitted in appointments obtained through the telematic tools provided by the consular offices.”
Objective: a more agile administration
The General Directorate of Legal Security and Public faith stressed that the implementation of this system pursues a more effective electronic administration. “It is convenient to enable, with due guarantees, the presentation of requests for prior appointment through telematic tools that allow (…) to manage in a more agile and guarantee way the requests for nationality per option,” says the instruction.
The new procedure also guarantees the generation of application records and acknowledgments of receipt, respecting the chronological order in accordance with the Common Administrative Procedure Law. With these modifications, the authorities seek to ensure that the process is more accessible, transparent and orderly for the descendants of Spaniards who wish to benefit from the Democratic Memory Law.
