SNP insists on fishing in prohibited area of ​​the Paracas National Reserve

The National Fisheries Society (SNP) appealed Indecopi’s decision not to comment on the lawsuit filed by the industrial fishermen’s union to declare the legal prohibition on extracting species in the Paracas National Reserve as a “bureaucratic barrier.”

In order to refrain from issuing a position regarding the SNP’s lawsuit, the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) argued that it was preferable for the Supreme Court to first resolve an appeal by the businessmen against the decision of the Second Constitutional Chamber of the Superior Court of Lima.

In the first week of June this year, the aforementioned Court dismissed the popular lawsuit filed by the SNP against the National Service of Natural Protected Areas by the State (Sernanp), which rejected a request for authorization for the purpose of carrying out industrial fishing activities in the Paracas National Reserve.

The Judiciary rejected the SNP’s arguments, according to which current regulations allow fishing in prohibited areas such as the Paracas National Reserve, which was rejected by the Court, indicating that this claim lacks foundation.

Coincidentally, today marks the 49th anniversary of the creation of the Paracas National Reserve, where fishing has been completely prohibited for more than decades as a measure to protect this area, which is the natural habitat of very sensitive species.

After the SNP appealed the ruling of the Second Constitutional Chamber of the Superior Court of Lima, Indecopi announced that it will wait for the Supreme Court to rule on the appeal filed by the fishing businessmen’s union.

However, the National Fisheries Society expressed its disagreement with Indecopi’s decision and also appealed the decision of this body, which demonstrates the determination of industrial fishermen to extract marine species in the Paracas National Reserve.
