The SNMPE expressed its concern regarding a bill that is being discussed in Congress that would aim to promote the development of RER projects, proposing a series of modifications to the regulatory framework of the electricity sector that will affect the functioning of the electricity market and harm the users.
“If we analyze said bill, what is really sought is the creation of ad-hoc conditions for solar generation projects to sign contracts to meet a demand that by their very nature they cannot do,” stated the mining and energy union. .

Likewise, he said that, to guarantee the demand of regulated users, it is necessary to have energy and power 24 hours a day, but solar generation units do not have this attribute.
Despite this, – he noted – the bill seeks to create the conditions so that solar generation units can bid in the daytime block – which is the only time in which they can operate – and that the night and early morning hours are served by other technologies. “This situation shows that special conditions are being implemented for the development of solar projects, putting at risk the supply of 24-hour supply as required, in addition to eliminating the possibility that the total cost of the energy that the client receives is the most competitive for domestic and commercial users,” he commented.
On the other hand, he indicated that stating that if this project is not approved the rates for domestic users will increase lacks any basis and that exactly the opposite could happen, since the proposed scheme does not guarantee the lowest rate for 24 hours. , but only for the day block, which is the only objective pursued by its promoters.
In this context, the SNMPE cited that the recent experience of neighboring countries shows that the massive entry of these technologies without establishing regulatory conditions that protect the balance of the system has generated that user rates, instead of being reduced, in many cases have been reduced. have increased. Regarding the supposed barriers to market entry that the RER generation would have today and the impossibility of competing on equal terms with other technologies, the union said that this statement does not correspond to reality and that the numbers refute it.
“Between June 2023 and September 2024, 798 MW of RER projects have been put into operation (195 MW solar and 603 MW wind) and it is expected that between July and December 2025 approximately 456 MW more of these technologies will enter the system; In addition, there are approximately 2,255 MW of projects with studies that could come into operation between January and September 2026,” he explained.
The business association stressed that the promotion of the use of renewable energies in the generation of electricity in Peru does not need ad hoc regulations, which rather than encouraging its development will only bring with it a serious risk for the operation of the national electrical system and will not benefit with lower rates to end users.
Finally, he stated that, if the aim is to really encourage the development of the RER, the extension of the benefit of accelerated depreciation of the income tax for electricity generation activities based on water resources or renewable resources should be approved in the short term. , which is a powerful tool for promoting these technologies.
