MÉRIDA, Mexico – A 55-year-old HIV-positive man was recently sentenced to 18 years in prison in Sancti Spíritus for sexually abusing a minor with a mental disability.
The aggressor, despite knowing that he was a carrier of acquired immunodeficiency syndrome (AIDS), had unprotected sexual intercourse with a mentally affected child on several occasions, reported a report from the official newspaper Escambray.
The incident occurred in 2023, at the home of a friend of the teenager’s mother, where he stayed overnight on some weekends, the report states.
The attacker, the tenant’s brother, “managed to seduce him with lascivious treatment, hidden from the other members of the family, and to consummate the sexual act with the minor on several occasions,” the report says.
“When the teenager became withdrawn from school, his teachers managed to get him to confess what was happening, and then they accompanied the mother and jointly filed a complaint with the corresponding body of the Ministry of the Interior,” they report.
The official press report, which rarely reports on cases of this nature, took the opportunity to blame “the overconfidence and naivety of relatives, who do not realize the dangers of some relationships between minors and adults, and even with older children.”
The victim, “with a defective level of psychological functioning, has a mental age below his chronological age, which is why he receives educational treatment in a special education center.”
Escambray He states that “this has not been the only case of this nature during 2024 in the First Criminal Chamber of the Provincial People’s Court of Sancti Spíritus.”
“In imposing the sentence on the accused, the judges took into account the significance of the crime, which was committed against a minor with significant limitations, and the degrading attitude of the perpetrator who, knowing that he was carrying an infectious disease, did not protect himself,” the report reads.
The note adds that the aggressor had no criminal record, which influenced the sentence (case 137 of 2023) of the First Criminal Chamber of the Provincial People’s Court of Sancti Spíritus.
Sexual abuse of a minor in Granma
A 40-year-old man, resident in the province of Granma, was sentenced by the Municipal Court of Buey Arriba to only three years of correctional labor without confinement for the completed crime of sexual abuse of a girl four years, as evidenced by the criminal case report.
The aggressor, Maikel Solano Arévalo, is the husband of a neighbor of the girl who sometimes took care of her. On one occasion, before July 2023, he took advantage of the fact that the little girl went to his house, without the supervision of any adult relative, and there, he took her to a room, took off her clothes and satisfied his instincts, without penetration.
The victim gave his statement to the psychologists from the police and exposed “in a precise and certain manner each of the actions that the defendant carried out”, and indicated which was the place chosen by him to “satisfy his libidinous instincts”, according to the criminal document shared by the media Marti News.
