The Chamber of Deputies is studying today the project that classifies sexual abuse as a crime, raising prison sentences to 25 years, depending on the aggravating circumstance, and introducing chemical castration as a surveillance measure.
Legislators from various parties signed the bill that modifies articles 72,128, 130, 131 and 135 of Law 1160/97 of the Penal Code, which aims to increase the custodial sentence and replace the figure of crime, for that of crime , to those who commit sexual abuse or actions that involve sexual acts to children or other older persons.
In the current article 72, which speaks of the types of measures, which may or may not be deprived of liberty and which will be for surveillance, improvement or security, it is introduced in the second paragraph, section 4, lto chemical castration for life, upon serving the custodial sentence corresponding, for punishable acts established (128,130,135) in this law.
In article 128, on sexual coercion and rape, a custodial sentence is stipulated. 20 years and older, whatever the age of the victim.
Number four of this same article indicates that after serving the prison sentence, chemical castration will be applied, as a surveillance measure.
The same penalty is provided when the victims are defenseless people, who are in a state of unconsciousness or who for any other reason are unable to offer resistance. Chemical castration is also included once the prison sentence has been served.
Regarding article 135, of sexual abuse in children, a sentence of freedom from 10 to 25 years is foreseen. When more than one circumstance occurs, the penalty will range from 20 to 25 years.
Regarding 135, section B, regarding abuse by technological means, on which by means of electronic communications or any transmission of data requests or requires a child to perform sexual acts or send images of himself, he will receive 5 to 10 years from jail The attempt will also be punished.
