Sandra Hernández, wife of National Guard Sergeant Major Luis Bandres Figueroa, denounced on Tuesday night that he had been arbitrarily transferred to the Charallave Military Prisoners and Detainees Center without a court order.
“My husband has been the victim of an arbitrary transfer by General Luis Ojeda, who is the director of Dispemil (General Directorate of Military Penitentiary Service). I must remind you that my husband is currently in a legal limbo,” Hernandez said in a statement. a video.
She explained that in the case of her husband, who was detained in the Ramo Verde prison, the trial and his conviction were annulled, so “the entire procedure must be started again from the preliminary hearing, which means that my husband currently does not have a judge in charge of his case.”
In June 2022, 23 sergeants involved in the military uprising in Cotiza – which occurred in January 2019 – were condemned to sentences of seven years and nine months; while Sergeant Luis Bandres, who was identified as the ringleader of the uprising, was sentenced to 15 years and nine months in prison for the crimes of treason, instigation to rebellion, mutiny, disobedience, theft of effects belonging to the National Armed Forces and insulting the Armed Forces.
In April of this year, the Constitutional Chamber of the Supreme Court of Justice reviewed an appeal against the sentence against Bandres Figueroa and First Sergeants Yordanis Camacaro and Alberto Piñango Salas, and ordered the Criminal Cassation Chamber to review again the reasons for its admission, due to the fact that constitutional guarantees, due process standards and effective judicial protection were not taken into account.
Sandra Hernández questioned the transfer, as there was no judge who issued the order, and held General Ojeda responsible for “anything that may happen to my husband, since he has put his physical integrity at risk and in danger by taking him to another penitentiary without any order.”
