Gustavo Moreno, president of the Sixth Commission of the Senate of the Republic, filed a bill called ‘Stefania’s Law’ to put a stop to the poor management of swimming pool maintenance in Colombia.

The congressman’s initiative seeks to strengthen Law 1209 of 2008, which establishes safety standards for this type of construction that contains large amounts of water and is intended for recreational bathing, swimming or other water sports and exercises: “It doesn’t talk about the quality of the water and whether it is contaminated”the Santander legislator alleged.
“When you get into a pool, you don’t know when the last microbiological test was done”argued the senator in the Congress of the Republic alongside Tatiana González, mother of Stefanía Villamizar González, a girl who died on June 28, 2023 after contracting a parasite in a swimming pool in Santa Marta.
“A senator put a spoke in the wheel of this project a few days ago. Today Javier Acosta and Estefanía have contributed their lives. You cannot protect the interests of private individuals over the lives of Colombians,” the senator said on his social networks.

Javier Acosta died this Friday, August 30 in Bogotá, due to a fungus contracted in a swimming pool, according to his testimony before the euthanasia procedure, a story that has moved all Colombians.
What does Law 1209 of 2008 that the senator mentions say?
The purpose of this regulation is to establish the rules aimed at providing safety and adapting swimming pool facilities in order to avoid accidents, health problems and protect the lives of their users, without prejudice to the provisions of other regulations that may be applicable to them on a concurrent basis.
The security measures established by law are set out in Article 11, which must be complied with by those responsible for swimming pools throughout the country.
Any natural or legal person, public or private, that provides swimming pool services must comply with the following minimum safety standards:
- Children under twelve (12) years of age should not be allowed access without the company of an adult.
- Water must be kept clean and healthy at all times, complying with the hygiene and health requirements established by the respective health authority. Chemical disinfection treatment must meet the conditions established by the regulations to protect the health of users.
- A first aid kit with healing materials should be available.
- At least two (2) circular floats with rope and a stick with a hook must remain in the pool area.
- The maximum depth of the pool must be written in bright colours and in large letters, clearly visible to anyone.
- There must be a telephone or intercom in service twenty-four (24) hours a day at the pool site for emergency calls.
- It is mandatory to implement approved safety devices, such as: protection barriers and access control to the pool, immersion detectors or water alarms that immediately activate an alarm system equipped with a siren and protection to prevent entrapment.
