These changes seek to care for and conserve the environment through Circular Economy policies and mechanisms to increase the useful life of products; minimize, recover, use and valorize waste.
The explanatory memorandum mentions that Mexico faces an environmental crisis linked to the linear model of production and consumption and that is characterized by the sequence of extracting, producing, consuming and discarding.
Said model, the reform points out, has generated cumulative environmental impacts that affect both the health, the economy and the environmental security of the country.
These modifications establish that the Circular Economy is an economic model of sustainable production and consumption that includes systemic solutions for economic development, which reduce the environmental impact through technical and biological cycles that allow the permanence and sustainable reintegration of product materials into the economy.
In addition, the reform creates the National Circular Economy System to regulate policies, powers and actions. The purpose of this is coordination between the three levels of government to fulfill the purposes of the Circular Economy.
A Platform of the National Circular Economy Public Information System is also created, for the registration and dissemination of information on the subject of Circular Economy. The agencies of the Federal Public Administration will participate in this.
This platform will have basic dissemination information on the Circular Economy, information on service models, data that allows the adoption of Circular Economy practices in the population and productive sectors, as well as the directory of companies that have the national Circular Economy badge.
In the transitional articles it is mentioned that the Executive Branch will have 180 calendar days – after the entry into force of this law – must issue the regulations of the General Law of Circular Economy.
At the same time, state congresses will also have 180 calendar days to adapt and harmonize their legislation with the new provisions.
