The Senate approved this Tuesday (24) Bill (PL) 5391/20, which establishes stricter rules for those convicted of homicides of police officers and other security agents. The project amends Law No. 11,671, of May 8, 2008, which deals with the transfer and inclusion of prisoners in maximum security federal penal establishments and now goes to the Chamber of Deputies for analysis.
According to the proposal, prisoners – provisional or convicted – for the crime of qualified homicide when committed against an authority or member of the prison system, the National Security Force, the police, the Armed Forces, or their relatives will be sent to maximum security federal penal institutions.in the exercise of the function or as a result of it or against your spouse, partner or blood relative up to the third degree, due to this condition.
The project also proposes changes to the Criminal Execution Law with regard to the institution of the Differentiated Disciplinary Regime (RDD), so that prisoners who commit homicide against military personnel and public security agents are included in this regime.
The proposal also includes in the RDD prisoners who have repeatedly committed crimes involving violence against the person or serious threat, heinous or similar. The reiteration will be recognized from the second conviction onwards, with no final judgment being required.
