Chifagate triggered a parliamentary initiative against José Jerí
The vacancy motion against José Jerí maintains that the president engaged in conduct incompatible with the dignity of the office by holding unregistered meetings with a Chinese businessman, outside the official agenda and without informing the Congress nor to the citizens. For the signatories, these meetings violate the principles of transparency, probity and accountability that should govern the exercise of the Presidency and compromise public trust in the leadership of the State.
The document indicates that these events do not constitute simple administrative irregularities, but rather constitute politically reprehensible behavior that affects the legitimacy of the presidential function. Under the jurisprudence of the Constitutional Court, permanent moral incapacity is linked to acts that reveal a lack of suitability to exercise power, especially when national interests are compromised or suspicions of undue influence on Executive decisions are generated.
Furthermore, the document states that the permanence of José Jerí in office has created a scenario of institutional distrust and weakening of presidential authority. For this reason, it suggests that it is appropriate to activate the constitutional mechanism of political control to restore the balance of powers and protect the integrity of the public service against conduct considered incompatible with the presidential investiture.
Six motions of censure were also presented
He Congress accumulates six censorship initiatives against José Jerípromoted by groups and congressmen from different stores, all supported by the loss of ethical suitability, the lack of transparency and the unregistered meetings with the Chinese businessman Zhihua Yang. The motions, presented by Ruth Luque, Elías Varas, Jaime Quito, Edwar Málaga, Renovación Popular and Edwin Martínez, agree that these off-schedule meetings, added to alleged conflicts of interest, contradictory versions and questions about his handling of the security crisis, constitute conduct incompatible with the presidential investiture and with the minimum standards of probity in public office.
Added to these questions are complaints about decisions taken during his interim administration, the deterioration of the country’s international image, the increase in criminal violence and the alleged influence of business interests linked to strategic projects such as the Pachachaca 2 hydroelectric plant. Taken together, the initiatives suggest that the permanence of José Jerí in office weakens institutional legitimacy, affects citizen trust and justifies the exercise of political control for his removal, either through censorship or through a vacancy motion.
