The first room of the Supreme Court of Justice of the Nation (SCJN) resolved a case in which a man was sentenced to 15 years in prison for the crime of trafficking in persons, in the modality of sharing video recordings with the participation of children under 18 in sexual acts.

The sanction is provided for in article 16 of the General Law to prevent, sanction and eradicate the CRIMES IN THE MATTER OF PEOPLE; However, the sentenced promoted a direct protection after considering the penalty of 15 to 30 years that the law contemplates unconstitutional.

His argument was that he is punished with the same severity both who produce material with minorslike those who share it, but the Collegiate Court rejected the amparo, so the case came to review before the SCJN.

After analyzing it, the first room stressed The complexity of human traffickingphenomenon that seriously affects human dignity and requires severe sanctions, especially when it involves girls, boys and adolescents.
