Minister Luiz Fux of the Federal Supreme Court (STF) voted This Wednesday (10) For the acquittal of Alexandre Ramagem (photo), former director of the Brazilian Intelligence Agency (Abin).
According to the prosecution of the Attorney General’s Office (PGR), Ramagem would have been acting to discredit the electronic voting system and to be part of a criminal organization to assist Bolsonaro in the dissemination of false news in 2022.
According to PGR, the deputy also participated in the so -called “Abin Parallel”to obtain information against Bolsonaro opponents and be aware of the illegal monitoring of Supreme Ministers and political disaffected from the former president.
Despite the accusations, Fux understood that Ramagem did not commit “concrete actions” or “serious threat” against democracy.
“The fact that documents found with the defendant Alexandre Ramagem confirm the ideological alignment between him and the president [Bolsonaro]does not lead to the conclusion that he practiced the crime of abolition of the Democratic Rule of Law people have their ideologies, “he said.
Crimes
Currently, Ramagem is a federal deputy. Being in the function, he benefited from the suspension of part of the accusations and responds only to three of the five crimes imputed by PGR.
The suspension applies to crimes of damage qualified by violence and serious threat, against the union’s assets, and with considerable damage to the victim and deterioration of overturned assets, related to the scammers of 8 January.
By Fux’s vote, branch must be acquitted by the crimes of coup, armed criminal organization and attempted abolition of the Democratic Rule of Law.

Despite the minister’s understanding, the score for the condemnation of Branch, Bolsonaro and six defendants are 2 votes to 1. The votes for the conviction were delivered yesterday (9) by the ministers Alexandre de Moraes and Flávio Dino.
After the vote on branch, the session was suspended. It was more than 13 hours of Fux’s voting.
The trial will be resumed on Thursday (11) at 14h.
