President Jair Bolsonaro sanctioned this Wednesday (6) the bill that determines the seizure of vehicles used in the trafficking of illicit drugs, even if they have been acquired legally. The text was approved by the Chamber of Deputies in February this year, and was just waiting for the sanction to come into force.
Until then, the restitution of vehicles seized in the transport of narcotics depended on proof of the lawful origin of the good. With the change in legislation, this proof will no longer be necessary, and if there is interest from public security agencies, the vehicles can be incorporated into their heritage. The measure covers motor vehicles, vessels, aircraft and any other means of transport or machinery.
The sanctioned law makes a reservation to protect the interest of third parties in good faith, such as rental companies or owners of stolen cars to be used by drug dealers. In such cases, the refund will be guaranteed.
The original bill was authored by Deputy Subtenant Gonzaga (PDT-MG), and changes the law that created the National System of Public Policies on Drugs (Sisnad). The approved version is a substitute that had been proposed and approved during the course of the matter in the Senate.
In the case of other goods seized from trafficking, other than transport vehicles, the current determination is maintained that allows the judge to allow the accused to present evidence or produce evidence, within five days, in order to prove their lawful origin. for your release.
