The lawyer of the oil businessman Samir Abudayeh, Aurelio Pastor Valdivieso, assured that his defendant will not take advantage of the figure of effective collaboration after his release. According to the lawyer, “There is no crime to attribute” during the 11 months in which the investigation corresponding to the Petroperú case has been carried out.
“Effective collaboration is a legal figure that is considered for those who have committed a crime. When a person has not committed a crime, they cannot be accepted to any effective collaboration and, in this case, we have been shown during 11 months of investigation that there is no crime to be attributed”, he told Exitosa.
Pastor’s statements came after the Superior Court of Justice of Lima ordered that the former head of the National Intelligence Directorate (DINI), José Fernández Latorre; businessman Samir Abudayeh; the former general manager of Petroperú, Hugo Chávez; and former intelligence adviser, Henry Shimabukuro, were released.
According to the First Criminal Appeals Chamber, no further evidence has been found to justify the arrest of the four involved in the Petroperú case. In this sense, he stated that this would not be a method to guarantee his participation in the investigations.
“We will continue to attend all summons from the Prosecutor’s Office. They have summoned us again for a procedure on December 7 that we are going to attend, and we are going to answer all the questions they want to ask us. There is a disorientation due to the lack of corroboration of his initial theory. The Prosecutor’s Office has been incorporating new things that have nothing to do with what they originally wanted to investigate, ”he asserted.
