The Departmental Court of Justice (TDJ) ruled in favor of the MAS bench to annul the elections of the president and work commissions of the Departmental Legislative Assembly (ALD) of Tarija.
While the opposition groups of Unidos e Indígenas questioned the resolution of the First Constitutional Chamber of that entity, which granted the guardianship of two assembly members of the ruling party, after the same amparo was rejected on August 8, 2021.
However, the Plurinational Constitutional Court (TCP) ruled revoke the decision and instructed that the appeal for amparo be admitted.
“This is an unappealable resolution and of obligatory compliance so that it can be annul the elections of the president of the ALD and of the commissions as a result of the amparo that was presented in 2021,” said the assemblyman and president of the MAS bench, José Yucra.
According to Yucra, there are ten days to convene another session and the president of the Legislative Assembly of Tarija is elected.
Assemblyman for United, Mauricio Lea Plaza, replied to the decision, stating that the ruling is “absolutely inconsistent” in legal terms and distorts the application of the regulations that govern the legislative entity, ignoring that it is the plenary session, as the highest instance, that decided to install the session, as established in the General Regulations.
“This is yet another proof of how bring political power to justice of the MAS and how this party tries to take over the leadership of the Assembly at all costs”, criticized Lea Plaza.
At the beginning of August 2021, the assemblyman of the tapiete people, José Luis Ferreira, was elected and inaugurated as head of the legislative body.
The amparo presented by two MAS assembly members against his election is based on the fact that the second vice president of the current board of directors was not empowered to call the session.
