The president of the Congress of the Republic, Fernando Rospigliosiassured that if Parliament approves a motion of censure against José Jerí, he would cease to be President of the Republic and a process would be opened to elect a new head of the Legislature, who would immediately assume the Presidency of the Republic, in accordance with the succession order established by the Constitution.
Rospigliosi explained that this situation would arise “whether we like it or not” if Congress, by a majority of votes (66), decides to censure Jerí under the motion presented, even though several constitutionalists have indicated that the correct way to remove the head of state for acts of functional misconduct would be vacancy and not censure, according to the majority interpretation consulted by himself.
“If that happens, the president would cease to be president, against the opinion of the constitutionalists, against my opinion and against the opinion of some people, but that is the reality. The votes are the votes and if he is censured, because that is what Congress has decided, Mr. Jerí will cease to be president of the Republic and Congress will immediately elect a new president of Congress who automatically becomes president of the republic. That is the reality. Whether we like it or not, whether we agree or not let’s agree,” he told RPP.
The parliamentarian indicated that the motion of censure presented argues for alleged acts of functional misconduct committed by Jerí during times when he held the Presidency of the Republic, which is why his departure from office is being promoted. If the request is approved, Congress would have to choose a new president of Parliament, who would automatically assume the head of state until the transition with the next elected president.
Rospigliosi also reiterated that, according to the text of the motion, the extraordinary plenary session convened would only deal with censure and not vacancy, so the debate in that scenario would be limited to that point. He also stated that he would not resign from his position as president of Congress if the censure were carried out, because the motion is directed exclusively against José Jerí.
