Faced with the citizen’s request for an immediate advance of the elections, Rosa Maria Palacios analyzed its viability and explains what could be done, according to the Constitution.
First, he commented that if Dina Boluarte resignation, due to the succession dictated by article 115, Joseph Williams he would take the presidency and would have to call elections immediately.
“Then comes the Organic Law of Elections, which has a lot of deadlines for a person to be registered on the electoral roll, for the parties to hold internal elections, to resign six months before if you have public positions of a certain level, for the registration of elected candidates and presentation of their resumes, for the presentation of government programs, and so I can continue (…)”, he said.
In addition, he asserted that the next president would have to be elected in the semester from January to June, because article 116 of the Constitution determines that the president is sworn in and assumes office on July 28 of the election year.
“If Congress self-dissolves tomorrow and Dina leaves, who is the president of Peru? Because someone has to rule until we have an election. It is a bit of logic, common sense, reading the Constitution, ”she maintained.
