Rio Justice revokes two arrest warrants against Sérgio Cabral

The 5th Criminal Chamber of the Court of Justice of Rio de Janeiro today (10) unanimously revoked two preventive arrest warrants against former governor Sérgio Cabral. In this way, only one arrest order remains in force against Cabral, issued by the former judge of the 13th Federal Court of Curitiba, Sérgio Moro, who is being analyzed by the Federal Supreme Court (STF).Rio Justice revokes two arrest warrants against Sérgio Cabral

The former governor has been in preventive detention for six years, since November 2016. Five preventive arrest warrants were issued against Cabral. Four of them have already been revoked by the courts, two of which have been converted into house arrest with electronic monitoring.

Defense

The decision was celebrated by the defense of the former governor. “Taken unanimously, the decision shows the collegiate’s commitment to the Constitution and due process of law, in addition to being eloquent in demonstrating the absolute absence of contemporaneity and reasons for keeping the former governor in prison, as demonstrated by the defense during the course of the trial. process”, says the note signed by the lawyers Patrícia Proetti, Daniel Bialski and Bruno Borragine.

STF

The 2nd Panel of the Federal Supreme Court (STF) analyzes the request for annulment of Cabral’s conviction imposed by former judge Sérgio Moro and the preventive detention order related to the case. The rapporteur, Edson Fachin, voted to maintain the prison.

Minister Ricardo Lewandowski voted for the repeal. The trial was interrupted by Minister André Mendonça’s request for a view. Ministers Gilmar Mendes and Nunes Marques are yet to vote.

Operation Calicut

Cabral was arrested under the Operation Calicut, in November 2016, accused of embezzling federal public resources in works carried out by the state government of Rio de Janeiro. The estimated loss is over R$ 220 million.

The investigation identified strong indications of cartelization of large works carried out with federal resources through the payment of bribes to public agents, among them, the former governor of Rio de Janeiro Sérgio Cabral, arrested at his residence in Leblon, a neighborhood in the south of Rio de Janeiro. .

In all, 38 search and seizure warrants, eight preventive arrest warrants, two temporary arrest warrants and 14 coercive conduct were issued by the 7th Federal Criminal Court of Rio de Janeiro, in addition to 14 search and seizure warrants, two of preventive arrest and one of temporary arrest issued by the 13th Federal Court of Curitiba.
