The Justice of Rio determined the blocking of BRL 198,000 from the accounts of Hospital Santa Branca to pay for the transfer and treatment of patient Daiana Chaves Cavalcanti. The decision was taken this Wednesday (20), by Judge Elizabeth Maria Saad, of the 5th Civil Court of Duque de Caxias, the municipality where the hospital is located.
Daiana was hospitalized in early June to undergo cosmetic procedures with plastic surgeon Bolivar Guerrero Silva, but claims that the abdominal surgery did not achieve the expected result and that she continued with open wounds. She even claimed to be in a “private prison” situation, as she would be prevented from leaving the hospital. The doctor, who is Ecuadorian, was arrested.
Lawyer Ornelio Mota Rocha, who defends the patient, claimed that he had already obtained two legal measures to transfer Diana to another hospital, but without success. This Wednesday, he was granted a preliminary injunction, granted by Judge Elizabeth Saad.
“I emphasize that this is a case of sensitive and urgent treatment to restore the plaintiff’s health, whose medical report shows significant weakness, with risk of irreparable damage. Thus, due to the lack of evidence in the process of compliance with the injunction granted, in order to give it effectiveness and in view of its content related to the necessary and speedy health treatment of the plaintiff, I grant the kidnapping in the face of the first Defendant and proceed on this date to the blocking the amount of R$ 198,210.00, sufficient to cover accommodation for 20 days in an apartment and 10 days in CTI, and its collection will depend on proof of the services spent ”, wrote the magistrate.
Santa Branca Hospital was sought to express its opinion on the blocking of the value, but has not yet commented. Regarding the accusations of “private imprisonment”, the hospital issued a statement, denying that there had been such a practice in its unit. He said that the patient was in a private room, with the right to a companion. And he pointed out that the doctor Bolivar Guerrero is not part of its corporate structure.
