The Court of Justice of Rio de Janeiro (TJ-RJ) rejected the complaint by the Public Ministry (MP) against Senator Flávio Bolsonaro in a process that involved investigations into the alleged cracking scheme in the state Legislative Assembly (Alerj). The decision, released this Monday (16), was taken by the Special Body.
The MP himself asked for the termination of the complaint, after the evidence used in the indictment was annulled by the Superior Court of Justice (STJ) and the Federal Supreme Court (STF). In the request, the MP acknowledged that, in view of the decision by the higher courts, none of the elements obtained from the analysis of the bank and tax data of the accused could be used to support the complaint, which listed possible signs of embezzlement, money laundering and other crimes.
According to the thesis accepted by the rapporteur of the case, judge Maria Augusta Vaz Monteiro de Figueiredo, the complaint was offered by those who had attribution to offer, described facts, in theory typical, and was supported by elements of information that were later recognized that were obtained illegally by the STJ.
As a result, the elements of information that justified the presentation of the accusatory piece were annulled. Also according to the decision, the rejection of the complaint for lack of just cause does not prevent the return of investigations.
The lawyer Luciana Pires, who defends the senator, expressed herself in a note, considering that the case is finalized: “The court of justice of Rio de Janeiro understood to reject the complaint involving senator Flávio Bolsonaro. The STJ had already annulled all the evidence. The defense understands that the case is closed and, if there is any development, the appropriate legal measures will be taken.”
