During the hearing held this Monday, the magistrate of the Fourth Preparatory Investigation Court of the National Superior Court indicated that the medical documentation presented “is the same” as two years ago, and also stressed that there is a risk of flight.
Likewise, the session began with the presentation of the defense of Sotomayor García, who asked to vary the preventive detention by house arrest by pointing out that he is a citizen over 65 years of age and that he suffers from diabetes.

However, after rejecting the request, Zúñiga Urday ordered the National Penitentiary Institute (INPE) and the Ancón I penitentiary to send letters so that the ex-burgomaster receives necessary medical care.
36 pretrial detention
In February 2020, Judge Richard Concepción Carhuancho ordered 36 months of preventive detention against Juan Sotomayor and former Fuerza Popular congressman Víctor Albrecht, both implicated in the Rich Port II case.
In his decision, the magistrate described the measure as necessary, proportional and justified, in order to guarantee the success of the process, avoiding the risk and escape and obstruction of justice by both investigated. The 36 months of preventive detention will expire on January 24, 2023.
Sotomayor and Albrecht are implicated by the prosecution as members of the Rich Port criminal network, which appropriated the resources of the Callao Public Cleaning Services Company (Eslimp) through the hiring of “ghost workers.”
