The ruling, which bears the signature of Judge Miguel Ángel Espino, details that on this occasion the appeal is not admissible because it was filed more than two years after the inquiry order issued by the Anti-Corruption Prosecutor’s Office.

In the opinion of the magistrates of the First Court of Justice, the defense of Martinelli Linares should have filed the appeal in a timely manner and not let so much time elapse.

However, the ruling highlights that this type of appeal may be presented again in the oral trial phase, in order to obtain a final ruling by the judge.

Martinelli Linares sought to revoke the decision of the third criminal case liquidator judge of August 5, 2021, who refused to declare null the investigation order against Martinelli Linares issued by the prosecution on January 11, 2019.
