After the President Dina Boluarte proposed the death penalty for rapists of minors, the Ministry of Justice and Human Rights (MINJUSDH) has ordered the creation of the Sectoral Commission to carry out public debates in order to evaluate the proposals aimed at expanding the application of this measure.
The Commission, temporary in nature (3 months), was made official through ministerial resolution No. 319-2024-JUS, published last December 14 in the Official Gazette El Peruano. During its period of action, its main purpose will be the preparation of a technical report that includes proposals to evaluate the application of the death penalty.

“The members of the commission must organize decentralized debates in various regions of the country that contribute to the fulfillment of its objective, with the participation of state institutions and representatives of civil society. As well as, disseminate the minutes of the debates in each region and their conclusions to finally prepare and disseminate the final report that includes the results of the debates,” indicates the ministry’s portal.
It should be noted that this Sectoral Commission has a Technical Secretariat in charge of the Technical Secretariat of the Special Commission for the Implementation of the Criminal Procedure Code, which can invite representatives of other public entities or private institutions and society to its sessions. civil; as well as specialized professionals, so that they can provide their opinions and contributions. APP proposes Peru’s departure from the American Convention on Human Rights
Alliance for Progress presented Bill No. 9761/2024, whichseeks to authorize the withdrawal of Peru from the American Conventionon Human Rights, known as the Pact of San José. This proposal includes the denunciation of the jurisdiction of the Inter-American Court of Human Rights and establishes conditions for possible reincorporation, focusing on issues of national sovereignty andthe death penalty.
The bill, authored byCongresswoman María Acuñaconsists of three articles. One of the main points is that the President of the Republic is authorized to begin the complaint process before the Organization of American States (OAS). Furthermore, in the case of reincorporation, this could only be carried out once the deadlines established by the convention have expired and with certain reservations regarding sovereign matters of Peru, such as the death penalty.
