“The undersigned has no objection to being authorized to travel to the Oriental Republic of Uruguay, under the same conditions imposed on previous occasions in the present incident,” said the prosecutor in the three-page opinion to which Télam agreed.
“In this way, I request the accused to commit to inform his return to Argentine territory within 48 hours of arrival. This provided that his presence is not required in the process in advance, before which he must assume the commitment to return immediately , in addition to the fact that at the moment in the procedural state in which the case is found, there is no glimpse of his appearance being required immediately, “he said.
Previously, the relatives of the deceased crew members had expressed themselves, who through a letter prepared by the lawyer Valeria Carreras, argued, among other reasons, that whoever summoned the former president, an investment fund called Becon Investment Management, in his invitation does not indicate neither domicile nor legal personality.
Likewise, they argued that for a defendant to be allowed to leave the country “there must be a reason of urgencyor health, or be essential”, and considered that these circumstances are not met in the case of Macri’s request.
“The judge will agree that it is not a matter of life or death, not even an issue that cannot be postponed in terms of work; in fact, there is not a single line in Macri’s presentation that gives an indication of the importance of attending to that meeting,” the lawyer stated in her brief.
He added that “because it is not an efficient and sufficient cause that merits authorization to leave the country, it should be rejected.”

Macri had requested to be absent from Argentina through a brief presented by his lawyer, Pablo Lanusse, who carried out the diligence before Judge Ercolini.
The procedural situation of Macri
On December 1, Macri was prosecuted by the federal judge of Dolores Martin Bava for illegal espionage on the relatives of the crew members of the disappeared submarine during the Cambiemos government, a resolution that was appealed by the defense of the former president.
But at the beginning of February, Bava sent to the Buenos Aires federal courts the cases in which these alleged maneuvers and those deployed from the so-called AMBA bases of the Federal Intelligence Agency (AFI) are investigated.
The magistrate sent the files to the courts of Comodoro Py because they were related to the D’Alessio case, which had already passed to Buenos Aires after a ruling issued late last year by the Federal Court of Criminal Cassation.
Both files passed into the hands of Ercolini, who was the one who stayed with the D’Alessio case by decision of the Buenos Aires Federal Chamber and after his colleagues María Eugenia Capuchetti and Ariel Lijo excused themselves from intervening.
The passage of these files to Comodoro Py had been demanded by the prosecutor Juan Pablo Curi after Cassación ordered the transfer of the D’Alessio case to the Retiro courts.
