Tomorrow, starting at 9 in the morning, the Permanent Commission of the Congress of the Republic debates the opinion that expands the process of the Comprehensive Mining Formalization Registry (Reinfo) until December 31, 2026 or until the entry into force of the Small Mining and Artisanal Mining Law (ASM) and its regulations.
In light of the support received in the first vote in the Plenary of Congress, the approval of the rule is taken for granted, which establishes that during the expansion period, the Ministry of Energy and Mines, in its capacity as the governing body of the process, will implement, among other measures, the necessary actions for the technical support of mining operators and the environmental and social supervision of the activities in the process of formalization.
On December 4, the Plenary Session approved, by 60 votes, the expansion of Reinfo. Eleven of the twelve parliamentary groups overwhelmingly supported the measure. In some of them, however, there were divisions with votes in favor, against and even abstentions.
The same did not happen, however, with the exceptional reincorporation of at least 50 thousand informal miners and the suspension of the Reinfo exclusion processes that are underway. Both points, it is recalled, were voted on outside the enlargement and were rejected.
Reinstatement
In the case of the proposal for the exceptional reincorporation of informal miners, this was rejected by 46 legislators who prevailed over the 43 who were in favor of the measure. On this point, only Renovación Popular voted entirely against; The rest of the benches – 11 in total – dispersed their votes in favor, against, abstention and without response.
The suspension of the exclusion process, meanwhile, was rejected by 47 votes compared to 41 who voted in favor.
With this background, the opinion arrives tomorrow for a second vote to the Permanent Commission that assumes the functions of the Plenary due to the legislative recess.
