Real estate alert!: They call to find out about NOM in housing

And it is that, issues such as the legal scope and amount of fines for not complying with the Official Standard (NOM) or not being precise with the exact details of the properties and even the lack of dissemination of this new regulation, are urgent issues that anyone who intends to sell a house must attend to.

“There are three branches that we have to take care of, that of the developers, of the real estate professionals or intermediaries and of the private sellers of a residential property”, he commented.

“(It is necessary) to understand the legal scope of (the NOM), because it can cost you your career.”

In the opinion of the specialist, it will be the small and medium-sized developers who face the greatest challenge of assimilating the new Standard and ensuring that it is complied with in day-to-day operations, as well as real estate professionals, who will have to monitor compliance with the regulatory process.

However, another segment of the population that should be aware of the scope of the Standard is the purchaser of living placewho if at any time decides to sell his property, will have to comply with the regulation in a timely manner and carry out a very exact process in the operation.

“If when you want to sell your property, you lose the information, because one of the most delicate parts of the Rule is that you have to have the architectural, structural and installation plans of the property, so almost no one has that information”, he explained.

“Then the one who is a buyer will later be a seller and at that moment, if they do not have the information, they may be affected.”

The immediate challenges

For Hanná, it is important that the information is disseminated in a more general way and is not only between chambers and organizations, but that the Standard is detailed to any person with a property, since at least 70% of the housing market inventory in the country , corresponds to the segment used.

“Around 70% (of purchases) is from living place used, and that is the one that worries me a lot, this information for people is very important, because you can get a fine from Profeco, very large, “warned the real estate manager.

“I am very concerned about the population, in some way those of us who are in this business are getting informed, but I think it is a fundamental issue for the entire population to know.”

Another issue that should be pointed out, Hanná pointed out, is whether the Federal Consumer Protection Office, which will have to review compliance with the Rulethe adhesion of the contracts and if there is sufficient and trained personnel to attend to the commercialization operations, since

even if it is not ready, a door could be opened to non-transparent practices.

“I hope that Profeco has the capacity for both reception, processing, and qualified personnel and above all with principles, because unfortunately, we have heard of some cases where there has sometimes been corruption, which hopefully there is not,” he questioned.

The benefits

For Tony Hanná, also coordinator of the Real Estate Sharks Forum, the Regulation is positive for giving transparency and clarity to the real estate dealsin addition to reducing irregular and “coyote” operations.

“If there is a real benefit with the Standard”, affirmed Antonio Hanná. “This Standard is going to clean up and organize the sector. The Standard is going to put people who do not work legally, work legally”.
