Rapporteur votes to archive Eduardo Bolsonaro's impeachment process

A request for review postponed the consideration of the preliminary opinion on the request for impeachment of federal deputy Eduardo Bolsonaro (PL-SP) in the Chamber Ethics Council of Deputies. At this Wednesday’s meeting (8), the rapporteur, deputy Delegado Marcelo Freitas (União-MG) voted to archive one of the cases against the parliamentarian. As there was a request for a collective opinion, the opinion must be voted on at the next meeting of the collegiate body. If approved, the case against Eduardo Bolsonaro will continue in the collegiate.

The request against Eduardo Bolsonaro was made by the PT. The party argued that the deputy’s conduct in the United States, where he has lived since February, is incompatible with the performance of parliamentary duties.

Because he did not present a defense or designate a defender, Eduardo Bolsonaro relied on the defense of a public defender from the Union, at the request of the President of the Council, Fabio Schiochet (União-SC), who argued for the formal ineptitude of the representation. The rapporteur followed the defense and voted for archiving.

Previously, Schiochet rejected a request for suspicion of the rapporteur, made by the PT leader in the Chamber, Lindbergh Farias, with the argument that Freitas had already expressed political ties to Eduardo Bolsonaro. The president of the collegiate stated that there was no formal impediment to declaring the suspicion.

Attacks

According to the representation, from foreign territory, through various channels and platforms, the deputy repeatedly launched attacks to defame institutions of the Brazilian State, with special virulence against the Federal Supreme Court (STF) and its ministerswhom he has publicly called “dressed up militiamen” and “dictators”. Furthermore, the representation cites an interview in which Eduardo Bolsonaro declared that: “without amnesty for Jair Bolsonaro, there will be no elections in 2026”.

The document also cites Eduardo Bolsonaro’s move to pressure North American authorities and political sectors in the United States with the aim of putting pressure on Brazilian authorities through international sanctions.

In the party’s assessment, the conduct constituted a “serious threat to the constitutional order and the conduct of the electoral process”, violating popular sovereignty.

“Such manifestations do not end in the sphere of opinion: the represented person sought – and according to himself, was partially successful – to influence US government authorities to impose sanctions against members of the Federal Supreme Court, the Attorney General’s Office and the Federal Police, in retaliation for the investigations involving his father and co-religionists”, says the representation.

Eduardo Bolsonaro is still the target of three more representations on the Ethics Council, which are awaiting a decision from the President of the Chamber, Hugo Motta (Republicanos-PB) on the agreement, to be processed together.
