He Legal Office of the University of the Republic (Udelar), who legally represented the woman who reported having been raped by a group of men in a neighborhood apartment Cordcriticized the actions of prosecutor Judith Rodríguez, considering that lacked “gender perspective” and that it did not explain why the evidence collected was “contradictory” or “insufficient” to bring the defendants to trial.
The three men who had been charged were dismissed this Monday, April 24, after the prosecutor Rodríguez requested it from judge Blanca Rieiro, who made room. The victim’s defense, made up of lawyers from the Legal Clinic, requested a re-examination of the case.
In the statement issued this Wednesday by the Legal Office, the lawyers affirm that disagree with the “assessment” made by the Prosecutor’s Office regarding the evidence collected in the case.
“The tool or analysis variable ‘gender perspective’ was not applied‘, its application being mandatory in this matter for the State, in addition to the fact that the prosecutor he did not specify the reasons why he understood the evidence as insufficient or contradictorythus preventing timely control by this technical defense,” they added. The victim’s defense was headed by lawyer Juan Raúl Williman.
On the other hand, the office requested that – in the event of granting the re-examination requested after the dismissal – the case not be left in the hands of the 8th Shift Sexual Crimes Prosecutor, Maximiliano Sosa. “Because he has already intervened several times in the investigation and in this sense, the guarantee that the case will be reviewed by a prosecutor who has not participated in the matter to date would not be fulfilled,” they add in the letter. .
