Santo Domingo.– The General Directorate of Public Procurement (DGCP) declared the nullity of a purchasing process carried out by the Santo Domingo Este City Council (ASDE) for the acquisition of LED lamps and sent the file to the Specialized Prosecutor’s Office for the Prosecution of Administrative Corruption (PEPCA), after documenting serious irregularities in the procedure.
The decision is contained in resolution RIC-0038-2026, through which the governing body annulled the minor purchase process no. ASDE-DAF-CM-2025-0091, intended for the “request for the purchase of 150 watt LED lamps to be used in lighting the different parks and avenues of the municipality ASDE“The measure was adopted after a hierarchical appeal filed by the company Dos García, SRL.
The DGCP established that, although the technical sheet of the procedure indicated that the award had to be made taking into account the “quality, durability and lower price offered”, the contract was awarded to a company whose economic proposal exceeded that presented by the appellant company.

Likewise, the regulatory body verified that Neither the evaluation report of the economic offers nor other documents were uploaded into the Electronic Public Procurement System (SECP). that evidenced the analysis of the proposals received, which constitutes a violation of the principle of transparency and publicity established in Law 340-06 on Public Purchases and Contracting.
The resolution also states that the award certificatedated August 12, 2025, was issued by the person in charge of the Department of Purchases and Contracting of the councildespite the fact that Regulation 416-23 provides that minor purchases below the thresholds They must be the responsibility of the Administrative and Financial Management, prior authorization from the highest institutional authority.
