He Public Ministry approved the implementation of 33 prosecutors of flagrance in nine fiscal districts of Peru, with the aim of giving greater speed to criminal proceedings. The decision was formalized through Resolution 045-2025-MP-FN-JFS, which includes the technical recommendations of the Office of Implementation of the new Criminal Procedure Code. The measure seeks to face procedural overload and guarantee an immediate response to those who are arrested in flagrant crime.

The role of Flagrance prosecutors
Flagrance prosecutors are specialized offices that deal exclusively with crimes in which the person is intervened while committing the act illicitly or immediately later. Its main function is to expedite criminal proceedings, allowing prosecutors to coordinate directly with the Police and the Judiciary to achieve immediate measures. This model seeks to reduce the delay in investigations and raise the effectiveness of justice in situations where evidence is evident.
The creation of these units is part of Law 32348, promulgated in April 2025, which established the National System of Justice specialized in criminal flagrance. The regulatory framework forces the cases to be attended in short deadlines, in order to protect the rights of the parties and avoid the congestion of common prosecutors.
Why was the creation of 33 Flagrance Prosecutors approved?
The decision responds to the high criminal incidence recorded in several regions of the country. Reports of the Technical Office of Implementation of the new Criminal Procedure Code warned that ordinary offices face an unsustainable charge of files. In addition, the 2025 public budget allocated more than 35 million soles to reinforce this system.
The resolution of the Board of Supreme Prosecutors indicates that the new prosecutors are a “rapid response against the increase in crimes committed in flagrance, which require immediate, articulated and efficient intervention”. With this, it seeks to restore the trust of the population in the criminal system and deter criminal behaviors.
Location of the new Flagrance prosecutors
The 33 prosecutors will be distributed in fiscal districts with greater demand for justice. Lima Centro will concentrate 9 offices, while Lima Norte, Lima Este, Callao, Arequipa, Cusco, Lambayeque, Piura and La Libertad will have 3 each. The selection responds to technical reports that identified these areas as criticism in terms of crime.
