Public hiring cancels education bidding process after finding “serious irregularities”

Santo Domingo.- The General Directorate of Public Contracts (DGCP) reported on Friday the nullity of the OCI-CC-LPN-2024-0003 public bidding procedure for “equipment of equipment Raised workshops in educational centers nationwide -segund Education.

Among the non-observance are the violation of article 20 of Law 340-06, of public hiring, as well as the principles of efficiency, economy and flexibility in view of the fact that the specifications and its amendment do not contain the necessary information for the elaboration and evaluation of offers.

Other irregularities committed by the Purchasing and Contracting Committee of the OCI cited in Resolution RIC-0015-2025, consists in the authorization of the technical proposal of the awardees despite the fact that several of the goods presented did not comply with the specifications techniques indicated in the specifications; violation of due administrative process for not having exhausted the instruction phase of the challenge resources presented in accordance with article 67 of the aforementioned law and the incorrect evaluation of credentials by the winner in its legal documentation.

Likewise, the lack of advertising of the acts of the procedure, because the documents corresponding to the stage of offering offers or the report approved by the Act of approval CC-0042-2024 are not published.

By means of the aforementioned resolution, the DGCP orders the OCI that due to the serious irregularities observed in the aforementioned process and in accordance with the due process provided in Law 41-08 of Public Function to identify the officials who participated in the process and determine the actions that could correspond for not giving their actions to the norms that govern the National Public Contracting System, in accordance with the provisions established in article 65 of Law 340-06.

Through a press release, the DGCP reported that, once the disciplinary procedure has been exhausted in accordance with due process, the OCI must inform the results to the governing body within five days, counted from the issuance of this decision.

Similarly, he ordered the referral of the aforementioned resolution to the Comptroller General of the Republic and its anti -fraud unit; to the Chamber of Accounts; to the Special Prosecutor’s Office for Persecution of Administrative Corruption; to the Ministry of Education (MINERD); to the Ministry of the Presidency, and the General Directorate of Government Ethics and Integrity (DIGEIG), so that within the framework of its roles and competences they can carry out the place investigations and take the corresponding measures.

The DGCP explained that, with this decision, the contracts signed following this process ceased to take effect and so that the Contracting Unit can obtain the required goods and services must carry out a new hiring process.
