The debate reached the high court following a claim of unconstitutionality against Article 28 of Law 1816 of 2016. This point establishes that departments that exercise a monopoly on liquor production by direct or contract, that is, that have their own liquor, may suspend the issuance of permits for the introduction into their jurisdictions of liquor produced in other regions.
According to a statement issued by the Court, the call is in response to the fact that differences were found regarding the operation of the distilled spirits monopoly regime in Colombia; the purpose and effectiveness of the measure, and the effect it generates in the distilled spirits market in Colombia, particularly in the brandy segment.

Among the thematic axes that will be addressed in the discussion, the exercise of the liquor monopoly by the departments will be explored in depth, as well as the purpose and effects generated by the demanded measure in the collection of liquor monopoly income and in plural participation in the market, particularly in the spirits segment.
It should be remembered that, although this mechanism was initially structured with a view to protecting local production, it became part of the conversation when the Government of Cundinamarca relied on this regulation to suspend the sale of Manzanares Yellow Liquor, produced by the Caldas Liquor Factory.
