Prosecutors will not be able to request the arrest of police officers who injure or kill when legally using weapons

This Wednesday, law 32181 was made official in the newspaper El Peruano, which seeks to guarantee the principle of presumption of innocence and provide greater protection to personnel of the National Police of Peru.

According to the rule, approved by Congress, prosecutors will not be able to request preliminary judicial arrest or preventive detention against agents of the National Police in a situation of activity when they use their weapons or means of defense in a regulatory manner and, as a consequence, injury or death occurs.

It was determined that judges and prosecutors will be prohibited from taking away freedom, under functional responsibility. To this end, articles 261°-A and 268°-B are incorporated into the New Criminal Procedure Code, Legislative Decree No. 957.

On the other hand, it is established that those over 80 years of age, for humanitarian reasons, will face their sentence in accordance with the scope of article 288° or article 290° of the New Code of Criminal Procedure.
