The defendant LDSC declared before the justice after the comparison of his DNA with that found among the victim’s belongings and the Rocha Departmental Prosecutor’s Office of the 2nd shift, in charge of the prosecutor Jessica Pereira, refuted this stating that the only reasonable explanation and that explains the presence of his DNA on Lola Chomnalez’s DNI and on the towel he had in his backpack is that he was one of the perpetrators of his murder.
With merit to the above, the Prosecutor’s Office understands the legal requirements to request the Prosecution and imprisonment of the accused as the alleged perpetrator responsible for the crime of very especially aggravated homicide.
“Prosecution is requested with imprisonment, attentive to the seriousness of the crime, the penalty to be imposed and the existence of previous crimes. In the case of the most serious crime provided for by the national legal order, it merits the existence and presumption of risk that the accused may seek to evade the action of justice in the event that the trial is carried out without being detained, in addition to being a crime which is punished with a penitentiary sentence”, they explain in the application.
Statement
Asked about the existence of DNA in the objects belonging to Lola Chomnalez, LDSC states that she was working in Valizas for the season from approximately the holidays (December 24, 2014 onwards) and that she used to walk to the beach in her free time. «(…) I walked down the main one to the left and I saw a pink backpack, like a forgotten backpack on the beach. Working in the supermarket I drop a beer locker that I asked the cashier for Band-Aids. The only thing I did was open the backpack, but I did not speak to her, nor did I see her…. I opened it, what I stole from the backpack was money, but it was within days of this, at least 15 days or more that I see on television… that the buried backpack had appeared…».
According to S.’s version, he leaves after stealing the money, leaving the backpack in the same place where he had seen it in the first place. Questioned about the discovery of the rucksack days later and buried, he points out that “(…) it makes no sense to take the rucksack two kilometers away. It doesn’t make sense, it was a backpack that was forgotten on the beach and nothing else, I didn’t do anything wrong (…) ».
