Despite the challenges presented by the plaintiffs of the ‘bribes at ABC’ case, the Sucre Prosecutor’s Office confirmed the dismissal issued against the dozen involved in this case and dictated the definitive file of the case, despite the accusations presented by the accusing parties.

“For the factual and legal grounds set forth, the undersigned Departmental Prosecutor of Chuquisaca, with the power conferred by Article 324, paragraph 3 of the Code of Criminal Procedure, ratifies the dismissal, issued by the Matter Prosecutor (…), ordering the conclusion of the process, must proceed to the cessation of all precautionary measures ordered against him, as well as the cancellation of his criminal record with respect to the present case”, indicates the operative part of the tax decision.

In September 2022, the deputy Héctor Arce (MAS-radical wing) filed a public complaint against the executives of ABC for agreeing to a bribe of Bs 18 million with the Chinese company Harbor in exchange for awarding it the construction of the Sucre-Yamparáez Double Track, which is a Bs 456 million project.

May 22 of this year, the prosecutors commission decided to close the case because they did not find major elements to go to trial, they found the money in a deposit and released the defendants. Deputy Arce was one of the first to react and challenged this decision.

The Ministries of Justice and Public Works also objected to the first tax decision, in the first case, their representative, Noel García Mollinedo, presented the memorial indicating that all the evidence presented was not taken into account and that they were obtained lawfully and that the fact existed.

Grover Bautista Suxo, on behalf of the Ministry of Public Works, only objected to the dismissal of one of those involved, María Galleguillos Arce, and requested that since there is one involved, the investigation should continue.

However, on June 30 of this year, the Chuquisaca Departmental Prosecutor’s Office announced its decision and closed the case definitivelywhich implies that None of the 12 defendants will be prosecuted.

The defendants in this case were: Cristian Mendieta Cardera, accused of passive bribery and improper use of influence; Juan Carlos Hidalgo Chura, for passive bribery, breach of duty, incompatible negotiations, use of a counterfeit instrument and undue use of influence; Zhengyuan Jin, for active bribery, contracts injurious to the State and illicit enrichment of individuals affecting the State.

The defendants: Javier López Quespi, Said Martínez Carballo, Cosme Agostopa Chaparro, Deymer Quispe Valencia and Carlos Rafael Chipana Vargas, were charged with the crimes of incompatible negotiations, use of a counterfeit instrument, passive bribery, undue use of influence and breach of duty; while Jesús Aguilar Suxo, for illicit enrichment of individuals affecting the State; William Ramiro Mamani Loza, for passive bribery and improper use of influence; María Isabel Galleguillos Arce, for ideological falsehood; and Hernán Palacios Márquez, for incompatible negotiations, use of a forged instrument, passive bribery, undue use of influence, breach of duty, contracts injurious to the State and uneconomic conduct, they also benefited.
