Prosecutor’s Office appeals decision that annulled oral trial against Keiko Fujimori for alleged money laundering

The National Prosecutor’s Office filed an appeal against the decision of the Judiciary that annulled the oral trial in the emblematic Cocteles case. The prosecutor Jose Domingo Perez described the ruling issued on January 13 as an “unjustified setback” in a process of high public relevance. This case involves the leader of Fuerza Popular, Keiko Fujimoriwho faces serious accusations of money laundering and criminal organization.

The Public Ministry argues that this decision not only affects the development of the case, but also puts at risk the possibility of timely judging the crimes investigated.

In his appeal, prosecutor Pérez highlighted that the accusation control stage had already concluded validly, complying with the provisions of the Criminal Procedure Code.

The annulment of the oral trial by the National Criminal Appeals Chamber generates uncertainty about the future of the process. According to Pérez, this resolution could set a dangerous precedent by allowing defendants in high-profile corruption cases to use legal resources to delay judicial processes.

The prosecutor also stressed that the Public Ministry had already presented sufficient evidence to justify the start of the oral trial. These include testimonies from former Odebrecht officials, who claimed that the Brazilian construction company illegally financed Fujimori’s presidential campaigns in 2011 and 2016 through undeclared contributions.

Next steps

The Judiciary must rule in the coming weeks on the appeal presented by the Prosecutor’s Office. If this is accepted, the oral trial could be resumed immediately, respecting the initial schedule. Otherwise, the case would return to the accusation control stage, which would imply a new delay.

“The procedural setback ordered by the Judiciary violates fundamental principles of speed and effectiveness,” Pérez declared to RPP. Likewise, he warned that the resolution could be interpreted as a maneuver to favor the accused and undermine the efforts of the Public Ministry in the fight against corruption.
