Santiago.- The Santiago Prosecutor’s Office deposited the request for a measure of coercion against Corporal de la National Police Alejandro Castro Cruz and/or Alejandro Castro de la Cruz, 30 years old, accused of killing the boy Donaly Martínez during the carnival celebration in this city.
The request, in which this body investigator requests that preventive detention be imposed for 12 months against the officer, was deposited before the Judicial Office of Permanent Attention Services by magistrate Gerardo Ponce, director of the Department of Internal Affairs of the Prosecutor’s Office and prosecutor Rosmari Rosario.
«The victims, 11-year-old DJMT and his father Anthony Ysauri Martínez Martínez, shared with other relatives and friends on Mella street almost Las Carreras avenue when the accused, in a defiant and aggressive attitude, carrying his visible firearm, orders them to go down the volume of the music and tries to occupy the music box of a vehicle with which they entertained the meeting, for which a witness, following the order, enters the vehicle with the horn” details the informative note of the institution.
He refers to the facts of the instance, that the police officer insists on taking the horn, unleashing an argument in which the victim and father of the adolescent participate, whom the accused assaults by spraying pepper spray into his eyes.
“The discussion continues when, continuing in his violent, defiant and abrupt attitude, the defendant walks away with the horn and for no apparent reason returns and points his manipulated weapon at Martínez and upon making contact with him, fires the firearm, marks Taurus, 9 millimeters, whose shot impacts the left arm and chest of the minor, causing his death,” the statement said.
Evidence from the Public Prosecutor’s Office
The Public Ministry has evidence that demonstrates the criminal responsibility of Castro Cruz, including material, documentary, expert and testimonial evidence.
Among others, this evidence includes the preliminary autopsy report, issued by the National Institute of Forensic Sciences (Inacif), which determined that “the cause of death of the victim DJMT under the age of 11 was due to a projectile wound of firearm, violent death, homicidal legal medical etiology, hypovolemic shock mechanism”.
The Public Ministry has granted the present process the violation of articles 186, 295 and 304 of the Dominican Penal Code, which typify and establish sanctions against abuse of authority against individuals and voluntary homicide, to the detriment of the victim DJMT (11 years old), represented by his father, Anthony Ysauri Martínez Martínez and violation of articles 186 and 309 of the Dominican Penal Code, which typify abuse of authority against individuals and blows and wounds to the detriment of the victim Anthony Ysauri Martínez Martínez.
The Judicial Office of Permanent Attention Services of Santiago set for this Thursday the knowledge of the request for a measure of coercion of the Public Ministry against the accused.
