Preventive detention confirmed for commissioner and two police officers in Piura

The judges confirmed the 9-month preventive detention of the El Obrero commissioner and two non-commissioned officers, investigated for the alleged crime of passive bribery in the exercise of police duties. They are being investigated for the crime of passive bribery, because they would have requested S/ 5,000 to return a truck even though it had all the documents in order at the El Obrero police station, in the Piura region.

The members of the Criminal Appeals Chamber with functions of Liquidator of Sullana confirmed the mandate of preventive detention of nine months of preventive detention ordered by the Criminal Court of Preparatory Investigation specialized in crimes of Corruption of Officials, against the commissioner of El Obrero Mayor PNP Francy Barzola Álvarez and the non-commissioned officers Andy Llenque Suclupe and Richard Cherres Antón for the alleged crime against the public administration in the form of passive bribery in the exercise of the police function.

The superior judges, after a four-hour hearing, validated the ruling issued by the anti-corruption judge, Carlos Lindo Yajamanco, who found serious elements of conviction that link them to the crime of passive bribery, both to the officer Cherres Antón as the alleged perpetrator and to the commissioner and the non-commissioned officer Llenque as accomplices.

Since there was strong suspicion to order their preventive detention, they issued the corresponding documents to order the immediate location and capture of those under investigation who had been facing their judicial process as free prisoners.

As is public, the police officers were denounced by the owner of a car that was seized on January 10 of this year during a police operation supposedly for having an arrest warrant from the 9th Civil Commercial Court of Lima for having a debt with a bank, and then detained him in the warehouse of the El Obrero police station.

Despite the fact that the intervened party showed the documentation proving his ownership, the police officers reportedly requested payment of 5 thousand soles in exchange for handing over the vehicle unit, being reported to the Police and Anti-Corruption Prosecutor’s Office.

Despite this, the police persisted in refusing to return the truck and conditioned it with the payment of S/5,000 in order to proceed with its delivery.

The case is investigated by the first Office of the Prosecutor’s Office Specialized in Corruption Crimes of Officials of Sullana, led by prosecutor Luis Ramos Rioja.
