President Jair Bolsonaro sanctioned today (5), with vetoes, Law 14,442, of 2022, which regulates teleworking and changes the rules of food aid. One of the vetoes applied by the president provided for the possibility for the worker to withdraw, in cash, the balance that was not used in the food allowance at the end of 60 days.
With this, the benefit can only be used, exclusively, for the payment of meals in restaurants and similar establishments and the purchase of foodstuffs in commercial establishments. The final text, originating from the Provisional Measure 1,108/22was published today (5) in Official Diary of the Union and also provides that the employer is prohibited from receiving discounts when contracting the supplier of the tickets.
telework
The text published today also defines teleworking [ou trabalho remoto] as the provision of services outside the company’s premises, which may be completely remote or hybrid, but without being able to be characterized as external work. This type of service provision must be included in the employment contract.
Still on the subject, the law defines that the employee subjected to telework may provide services by day or by production or task. The adoption of teleworking can also be used for interns and apprentices.
Employees with disabilities and with children or children under judicial custody of up to four years of age will have priority in teleworking.
Union Contribution
Bolsonaro also vetoed another part of the proposal, which made it mandatory to pass on any residual balances of union contributions to union centrals. For the Ministry of Economy, this is contrary to tax laws and would represent a potential expense for the Union.
The vetoes made by the President of the Republic will still be analyzed by Congress. For a veto to be overturned, an absolute majority of the votes of deputies and senators is required.
