The president of the Judiciary, Janet Tello Gilardi, highlighted the approval in the Plenary Session of the Congress of the Opinion that creates the National System of Justice Specialized in Criminal Flagrance, a measure that described as a key step in the fight against citizen insecurity. The proposal was backed by 91 votes in favor, none against and eight abstentions, and was exonerated from a second vote, which accelerates its implementation.
Tello Gilardi stressed that the new system constitutes an “effective mechanism” to face flagrant crimes and recalled that its creation was one of the demands he presented to Parliament during his recent message to the nation.
“I express my greeting and recognition to the congressmen who have taken an important step in passing this project as a mechanism to fight citizen insecurity, it was worth our insistence,” he said.
The approved system aims to guarantee a timely and efficient response to flagrant crimes through specialized units nationwide.
It will be composed of the National Council of Justice Specialized in Criminal Flagrance (CNJEFD) and the District Committees of Justice specialized in criminal flagrance, and chaired by the head of the Judiciary or a representative of this institution, and composed of the Public Ministry, the Ministries of the Interior, of Justice and Human Rights, and of Economy and Finance; National Police and National Penitentiary Institute.
Among its functions is the planning, supervision and evaluation of the operation of the specialized units, as well as the progressive creation of exclusive bodies to process these cases, such as courts, prosecutors, defenders and specialized police teams.
The standard establishes that the implementation will be gradual and will prioritize the districts with the highest criminal incidence and procedural burden.
The holders or the competent governing body of the institutions that make up the system will have the creation of organs specialized in criminal flagrance to exclusivity (jurisdictional bodies, fiscal offices, public defenders and specialized police), for the attention of processes in criminal flagrance, under functional responsibility.
It also indicates that the implementation of flagrance units is progressive and is carried out in accordance with the plan and schedule approved by the National Council of Justice Specialized in Criminal Flagrance.
